Wszyscy pozostali, a wiec i osoby uskarżające się na n.p. duszności, poprzez niejasne nowe zapisy, będą zmuszane do przedstawiania ZAŚWIADCZEŃ o stanie zdrowia pozwalającym na nienoszenie masek! A więc będzie wojna domowa i nerwówka z różnej maści służbami porządkowymi, będzie masa emocji i dzięki temu nastąpi zajęcie Polaków sprawami drugorzędnymi wobec planowanych fundamentalnych zmian w gospodarce, prawie własności, polityce itp, itd…

Przecież takiej „pandemii” nie można tak po prostu zmarnować!

Wszystko wskazuje na to, że bandytyzm będzie trzeba powstrzymać wchodząc na drogę prawną wobec tego obłąkanego biznesmena.

Zaświadczenia lekarskie okazywane kelnerkom – prawna „Białoruś” i pozew zbiorowy

Pragnę uspokoić i zapewnić, że nie napiszę jednego słowa o chorobach, w tym psychicznych, niniejszy felieton w całości poświęcam stanowi prawnemu. Wczoraj minister edukacji oświadczył, że od 1 września uczniowie i kadra nauczycielska wraca do szkół bez reżimu sanitarnego, jaki obowiązuje w miejscach publicznych. Dziś minister zdrowia Szumowski wycofał się ze swojego pomysłu, który głosił jeszcze tydzień temu, że będzie obowiązek zakrywania ust i nosa, bez względu na stan zdrowia i zamienił na nowe oświadczenie. Od 1 września, żeby było „zabawniej”, wszyscy obywatele RP, którzy brak zakrywania ust i nosa będą tłumaczyć stanem zdrowia, muszą okazać zaświadczenie lekarskie i tutaj zaczyna się prawna „Białoruś”.

Uczepiłem się tej nieszczęsnej Białorusi w celach prześmiewczych i paradoksalnych. Na Białoruś powołują się wszyscy, gdy mówimy o wolności i władzy zamachującej się na wolność obywatelską, paradoks polega na tym, że tak idiotyczny przepis tam nie obowiązuje, ale do rzeczy. Co proponuje Szumowski, dodajmy, że proponuje dziś i nie wiemy na jaki „genialny” pomysł wpadnie jutro. W największym skrócie prawnym minister zdrowia proponuje złamanie prawa niemal na wszystkich poziomach i obszarach:

1. Art 47 konstytucji, mówi o ochronie życia prywatnego, w przypadku chorób i stanu zdrowia, mamy do czynienie z dalej idącą ochroną, ponieważ mówimy o życiu intymnym, co jest odrębną kategorią prawną.

2. Przepisy RODO to kolejne rażące naruszenie prawa, uświadomię wszystkim, że zaświadczenie będzie mogła obejrzeć kasjerka w „Biedronce”, ochroniarz w hipermarkecie, kelner, pracownik stacji paliw, bileterka w kinie i pani sprzedająca warzywa na targowym straganie.

3. art. 40 §1 ustawy o zawodach lekarza i lekarza dentysty, w tym przypadku warto przypomnieć, że tajemnica lekarska obowiązuje wszystkich, prócz samego pacjenta. Zatem tylko i wyłącznie od woli pacjenta zależy, czy i komu udostępnia swoje dane o stanie zdrowia.

4. Art 24 kc, dobra osobiste. Zakres dóbr osobistych nie jest katalogiem zamkniętym, w orzecznictwie i doktrynie, dobra osobiste obejmują taki obszar, który można spisać w pracy magisterskiej. Mamy jednak art. 23 kc wskazujący na te dobra „najważniejsze” i na pierwszym miejscu jest zdrowie, na drugim wolność. Nikt nie może w państwie prawa zmuszać człowieka, aby wymachiwał zaświadczeniem o swoim stanie zdrowia na żądanie tysięcy osób.

5. Art 31 pkt 3 konstytucji, od którego właściwie powinienem zacząć i umieścić na pierwszym miejscu. Z mocy prawa, wyżej wymienionego, każda regulacja, która ogranicza wolności i prawa konstytucyjne może być zapisana wyłącznie w ustawie. Tymczasem Szumowski mówi o rozporządzeniu, co jest… prawną „Białorusią”.

W związku z powyższym przyszedł taki moment, że rozsądny obywatel musi powiedzieć dość, zanim na mocy rozporządzenia będzie musiał zdjąć majtki i poddać się badaniu per rectum, które wykona kelnerka w pizzerii. O ile tak idiotyczne przepisy i łamiące wszelkie reguły legislacji wejdą w życie, publicznie składam obietnicę, że z osobami zainteresowanymi wniosę pozew zbiorowy przeciw ich twórcom. Na koniec jeszcze raz pragnę powtórzyć, że nie chcę wchodzić w żadne dywagacje medyczne, poza zapisami prawnymi. Wojny plemienne na tym froncie, to odrębna kwestia, mnie interesuje stan prawny i egzekucji obowiązującego prawa będę się domagał.

Ponadto Piotr Wielgucki (ps. Matka Kurka) przygotował tekst zawiadomienia do prokuratury w sprawie nadużyć ministra Szumowskiego.

Zagrożenie dla życia i zdrowia tysięcy Polaków – wzór zawiadomienia do prokuratury

Niezwykle ciężko powstrzymać emocje, bo zarówno tryb, sposób, jak i rozporządzenie sprzeczne ze wszelkimi normami prawnymi i medycznymi, które zostało opublikowane w piątek w nocy, aż się chce podsumować siarczystą wiązanką. Nie czas jednak na puste przymiotniki, sprawy zaszły naprawdę bardzo daleko. Przez najbliższy tydzień czekają nas upały po 30 stopni i w tym czasie osoby z niewydolnością krążeniowo-oddechową, astmatycy, osoby z ostrym zapaleniem zatok, osoby z operacyjnymi przegrodami nosowymi, polipami, nowotworami dróg oddechowych, będą musiały zakrywać usta i nos we wszystkich miejscach publicznych zamkniętych.

Trudno uwierzyć, że takie rozporządzenie powstało w Ministerstwie Zdrowia, ale w odpowiedzi na barbarzyńskie bezprawie nie chodzi już o jakieś głupie manifestacje i „wolnościowe” spektakle, chodzi o życie i zdrowie tysięcy Polaków. Poniżej wklejam zawiadomienie do prokuratury, dołączam też swoją dokumentację medyczną, jednak to nie jest wymagane w przypadku tych osób, które chcą się powołać na swoje prawa, w tym prawo do ochrony życia i zdrowia. Im więcej takich indywidualnych zawiadomień trafi do prokuratury, tym więcej mamy argumentów w dalszym postępowaniu. Zawiadomienie można wysłać na adres elektroniczny Prokuratury Krajowej kontakt@ms.gov.pl, która ma obowiązek przesłać do właściwej miejscowo prokuratury, ale najlepiej wysłać pocztą tradycyjną do prokuratury wskazanej w zawiadomieniu. Treść zawiadomienia jest „uniwersalna”, swój adres i opis konkretnego przypadku zdrowotnego oczywiście musicie zmienić. Uwaga! Osoby, które chcą złożyć zawiadomienie i domagać się ścigania na wniosek, nie muszą być chore, wystarczy, że nie godzą się na poddawanie zabiegom leczniczym bez zgody lub/i uważają, ze te zabiegi narażają na utratę życia i zdrowia.

ZAWIADOMIENIE
o podejrzeniu popełnienia przestępstwa

Na podstawie art. 304 § 1 k.p.k. w związku z art. 31 pkt 3 Konstytucji RP i art. 231 k.k. oraz art. 160 k.k. i art. 192 k.k., zawiadamiam o podejrzeniu popełnienia przestępstwa przez członków Rady Ministrów posiadających delegację ustawową na mocy art. 92 Konstytucji RP, którzy wydali: ROZPORZĄDZENIE RADY MINISTRÓW z dnia 7 sierpnia 2020 r., poz. 1356 w Dzienniku Ustaw, czym przekroczyli swoje uprawnienia, naruszyli przepisy kodeksu karnego i dopuścili się deliktu konstytucyjnego. W związku z powyższym, wnoszę o:

– wszczęcie postępowania z urzędu w zakresie przewidzianym w kodeksie karnym
– ściganie na wniosek pokrzywdzonego Piotra Wielguckiego, na mocy art. 192 §2 k.k.

UZASADNIENIE

W dniu 7 sierpnia 2020 Rada Ministrów wydała rozporządzenie, poz. 1356 w Dzienniku Ustaw, w sprawie ustanowienia określonych ograniczeń, nakazów i zakazów w związku z wystąpieniem stanu epidemii. W treści rozporządzenia znajduje się przepis o następującej treści:
