Rozporządzenie maseczkowe nie ma podstawy prawnej? co oni wyprawiają?

 „§24 Ust. 1 Rozporządzenia Rady Ministrów z dnia 7 sierpnia 2020 r. w sprawie ustanowienia określonych ograniczeń, nakazów i zakazów w związku z wystąpieniem stanu epidemii wskazuje, że „do odwołania nakłada się obowiązek zakrywania, przy pomocy odzieży lub jej części, maski, maseczki, przyłbicy albo kasku ochronnego”.

➔ Ww. rozporządzenie nie ma żadnych podstaw prawnych, bo:

1. Każde rozporządzenie musi być wydane w oparciu o ustawę. Rozporządzenie Rady Ministrów z dnia 7 sierpnia 2020 r. zostało wydane w oparciu o przepisy art. 46a i art. 46b pkt 1-6 i 8-12 Ustawy z dnia 5 grudnia 2008 r. o zapobieganiu oraz zwalczaniu zakażeń i chorób zakaźnych u ludzi. Powyżej wskazane przepisy ustawy umożliwiają obowiązek poddania się badaniom lekarskim oraz stosowaniu innych środków profilaktycznych (czyli np. noszenia maseczek) i zabiegów przez osoby chore i podejrzane o zachorowanie.

A zatem od osób, które nie są chore i nie są podejrzewane o zachorowanie, nie można domagać się noszenia maseczek, czy też zakrywania ust i nosa.

2. Ponadto, jedynie ustawa wydana w czasie trwania stanu nadzwyczajnego, mogłaby skutecznie nałożyć na nas obowiązek zasłaniania ust i nosa. Jak doskonale wiemy, w Polsce nie wprowadzono stanu nadzwyczajnego (czyli stanu wojennego, stanu wyjątkowego lub stanu klęski żywiołowej). Powyższe zostało potwierdzone m.in. w Wyroku Sądu Rejonowego w KOŚCIANIE, sygn. akt II W 71/20

3. Idąc dalej za głosem sądu, który w Postanowieniu z dnia 01.09.2020 roku Sygn. akt. V W2703/20 w uzasadnieniu stwierdza, że w przywołanym rozporządzeniu nie przewidziano sankcji natury karnej lub wykroczeniowej za złamanie ustanowionego nakazu, np. poprzez odwołanie się do art. 54 kw, W orzecznictwie jednoznacznie przyjmuje się, że brak takiego odesłania uniemożliwia pociągnięcie danej osoby, która nie stosuje się do przepisów porządkowych, do odpowiedzialności wykroczeniowej (wyrok Sądu Najwyższego z dnia 20 października 2009 roku w sprawie III KK 266/09 oraz wyroki Sądu Najwyższego z dnia 19 sierpnia 2009 roku w sprawach III KK 230.09, III KK, 232/09 i III KK 233/09. W konsekwencji należy stwierdzić, że czyn polegający na naruszeniu obowiązku zakrycia przy pomocy odzieży lub części odzieży lub jej części, maski maseczki, przyłbicy albo kasku ochronnego ust i nosa NIE STANOWIŁ WYKROCZENIA.

4. SANEPID – PAŃSTWOWY POWIATOWY INSPEKTOR SANITARNY w Gdańsku pismem z dnia 01.09.2020 SE.HŻ-10/073/257/DD/20 stwierdza co następuje:

a. Personel placówek handlowych nie jest upoważniony do egzekwowania nakazu noszenia maseczek przez klientów na terenie sklepów.

b. Organy Państwowej Inspekcji Sanitarnej nie mają UMOCOWANIA PRAWNEGO do nakładania kar pieniężnych za naruszenie nakazu noszenia maseczek. A zatem nie ma podstaw prawnych do nakładania mandatów karnych z tytułu nakazu naruszenia noszenia maseczek. W obecnym stanie prawnym organy inspekcji sanitarnej mają jedynie możliwość monitorowania stanu przestrzegania przez obywateli nakazu noszenia maseczek i ewentualne zgłaszanie organom ścigania miejsc, które powinny być szczególnie objęte patrolowaniem przez Policję, która ma umocowanie prawne do nakładania mandatów karnych.

POLICJA NIE MOŻE UKARAĆ MANDATEM, gdyż czyn polegający na naruszeniu obowiązku zakrycia przy pomocy odzieży lub części odzieży lub jej części, maski maseczki, przyłbicy albo kasku ochronnego ust i nosa NIE STANOWI WYKROCZENIA. – patrz pkt 3.”

w sprawie ustanowienia określonych ograniczeń, nakazów i zakazów w związku z wystąpieniem stanu epidemii
Na podstawie art. 46a i art. 46b pkt 1–6 i 8–12 ustawy z dnia 5 grudnia 2008 r. o zapobieganiu oraz zwalczaniu zakażeń i chorób zakaźnych u ludzi (Dz. U. z 2019 r. poz. 1239, z późn. zm.1)) zarządza się, co następuje:

USTAWA z dnia 5 grudnia 2008 r. o zapobieganiu oraz zwalczaniu zakażeń i chorób zakaźnych u ludzi

Art. 46a. W przypadku wystąpienia stanu epidemii lub stanu zagrożenia epidemicznego o charakterze i w rozmiarach przekraczających możliwości działania właściwych organów administracji rządowej i organów jednostek samorządu terytorialnego, Rada Ministrów może określić, w drodze rozporządzenia, na podstawie danych przekazanych przez ministra właściwego do spraw zdrowia, ministra właściwego do spraw wewnętrznych, ministra właściwego do spraw administracji publicznej, Głównego Inspektora Sanitarnego oraz wojewodów:
1) zagrożony obszar wraz ze wskazaniem rodzaju strefy, na którym wystąpił stan epidemii lub stan zagrożenia epidemicznego,
2) rodzaj stosowanych rozwiązań – w zakresie określonym w art. 46b
– mając na względzie zakres stosowanych rozwiązań oraz uwzględniając bieżące możliwości budżetu państwa oraz budżetów jednostek samorządu terytorialnego.

Art. 46b. W rozporządzeniu, o którym mowa w art. 46a, można ustanowić:
1) ograniczenia, obowiązki i nakazy, o których mowa w art. 46 ust. 4;
2) czasowe ograniczenie określonych zakresów działalności przedsiębiorców;
3) czasową reglamentację zaopatrzenia w określonego rodzaju artykuły;
4) obowiązek poddania się badaniom lekarskim oraz stosowaniu innych środków profilaktycznych i zabiegów przez osoby chore i podejrzane o zachorowanie;
5) obowiązek poddania się kwarantannie;
6) miejsce kwarantanny;
7) (uchylony)
8) czasowe ograniczenie korzystania z lokali lub terenów oraz obowiązek ich zabezpieczenia;
9) nakaz ewakuacji w ustalonym czasie z określonych miejsc, terenów i obiektów;
10) nakaz lub zakaz przebywania w określonych miejscach i obiektach oraz na określonych obszarach;
11) zakaz opuszczania strefy zero przez osoby chore i podejrzane o zachorowanie;
12) nakaz określonego sposobu przemieszczania się.
